1. Acceptance of Terms

By accessing and using Axis One ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by these terms, please do not use this service.

2. Description of Service

Axis One is a multi-tenant fitness tracking platform that provides tools for trainers, clients, and fitness businesses to track progress, manage clients, create workout and nutrition plans, and analyze business performance. The service includes web and mobile applications, data storage, and AI-powered features.

3. User Accounts

Account Creation: You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials.

Account Security: You are responsible for all activities that occur under your account. Notify us immediately if you suspect unauthorized use of your account.

Account Types: Different account types (Trainer, Client, Business Owner, Super Admin) have different permissions and access levels. You agree to use your account only for its intended purpose.

4. Acceptable Use

You agree not to:

  • Use the service for any illegal or unauthorized purpose
  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights of others
  • Upload malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to any part of the service
  • Share your account credentials with others
  • Use the service to spam or harass other users
  • Reverse engineer or attempt to extract source code from the service

5. Subscriptions and Payments

Billing: Subscription fees are billed in advance on a monthly or annual basis, depending on your selected plan.

Auto-Renewal: Subscriptions automatically renew unless cancelled before the renewal date.

Cancellation: You may cancel your subscription at any time. Access continues until the end of your current billing period.

Refunds: Refunds are provided at our discretion. Contact support for refund requests.

Price Changes: We may modify subscription prices with 30 days notice. Continued use after price changes constitutes acceptance.

6. Intellectual Property

The service and its original content, features, and functionality are owned by Axis One and are protected by international copyright, trademark, and other intellectual property laws. Your use of the service does not grant you any ownership rights.

7. User Content

Ownership: You retain ownership of content you upload to the service, including workout plans, nutrition plans, and client data.

License: You grant Axis One a limited license to use, store, and display your content as necessary to provide the service.

Responsibility: You are responsible for ensuring you have the rights to upload any content and that it does not violate any laws or third-party rights.

8. Privacy

Your use of the service is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices regarding the collection and use of your information.

9. Limitation of Liability

To the maximum extent permitted by law, Axis One shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses. In no event shall our total liability exceed the amount paid by you in the 12 months preceding any claim.

10. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Indemnification

You agree to indemnify and hold harmless Axis One and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the service or violation of these terms.

12. Termination

We may terminate or suspend your account and access to the service immediately, without prior notice, for any reason, including breach of these terms. Upon termination, your right to use the service ceases immediately.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Axis One operates, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes by posting the new terms on this page and updating the "Last updated" date. Your continued use of the service after changes constitutes acceptance of the new terms.
